This paper explores how, at the 1875 Royal Commission on Vivisection, the anaesthetised animal was construed as a boundary object around which “cooperation without consensus” Computer supported cooperative work: cooperation or conflict? Springer, London, 1993) could form, serving the interests of both scientists and animals. Advocates of anaesthesia presented it as benevolently intervening between the scientific agent and animal patient. Such articulations of ‘ethical’ vivisection through anaesthesia were then mandated in the 1876 Cruelty to Animals Act, (...) and thus have had significant downstream effects on the regulation of laboratory animals in Britain and beyond. Constructing this ‘consensus’ around the anaesthetised animal, however, required first excluding abolitionists and inhumane scientists, and secondly limiting the interests of experimental animals to the avoidance of pain through anaesthesia and euthanasia, thereby circumventing the issue of their possible interest in future life. This consensus also served to secure the interests of vivisecting scientists and to limit the influence of public opinion in the laboratory to administrative procedure and scheduled inspection. The focus on anaesthesia was connected with discussions of what supporting infrastructures were required to ensure proper ethical procedure was carried out by scientists. In contrast to the much studied polarisation in British society between pro- and antivivisectionists after 1876, we understand the 1875 Commission as a conflict amongst scientists themselves, while also being an intra-class conflict amongst the ruling class. The National Commission for the Protection of Human Subjects of Bio-medical and Behavioral Research ended its work by substantially endorsing the status quo which places primary reliance on local Institutional Review Boards for subject protection. This was predictable because of the commission's researcher-dominated composition which permitted it to assume that research is good; experimentation is almost never harmful to subjects; and researcher-dominated IRBs can adequately protect the interests of human subjects. The successor Presidential Commission can learn much (...) by reexamining these premises. (shrink)

This text was first published as ‘De nova methodo naturam ac motum fluidi electrici investigandi’ in Novi Commentarrii Societatis Regiae Scientiarum Gottingensis. Commentationes physicae et mathematicae classis 8 (Göttingen 1778: 168–80). It also appeared in a printing by Joann Christian Dieterich in Göttingen in 1778. Lichtenberg delivered this talk personally to the Royal Society of Sciences in Göttingen on 21 February 1778. Although Lichtenberg was not present, he had already informed the Royal Society of Lichtenberg’s discovery of the (...) electrical figures at a meeting on 3 May 1777. The present German version was first published in Lichtenberg’s Vermischte Schriften, vol. 9 (Physikalische und mathematische Schriften, vol. 4) (Göttingen, 1806) pp. 49–80. Wolgang Promies suggests that the German translation was likely done by Friedrich Christian Kries, who was a co-editor of the Vermischte Schriften and Lichtenberg’s student (see Georg Christoph Lichtenberg [1974], Schriften und Briefe, [ed. This groundbreaking work on logic by the brilliant 19th-century English mathematician George Boole remains influential to this day. Boole's major contribution was to demonstrate conclusively that the symbolic expressions of algebra could be adapted to convey the fundamental principles and operations of logic, which hitherto had been expressed only in words. Boole was thus the founder of today's science of symbolic logic. Summing up his innovative approach, Boole stated, "We ought no longer to associate Logic and Metaphysics, but Logic (...) and Mathematics." As the great English logician Augustus De Morgan later put it, in praise of Boole, his genius consisted in showing that "the symbolic processes of algebra, invented as tools of numerical calculation, should be competent to express every act of thought, and to furnish the grammar and dictionary of an all-containing system of logic." The Laws of Thought lays out this new system in detail and also explores a "calculus of probability." The story of Boole's life is as impressive as his work. Besides rudimentary lessons from his father and a few years at local schools, Boole was largely self-taught. Revealing his aptitude for many subjects at an early age, he began his career already at age 16 as a teacher at a village school. In his leisure time he tackled the daunting works of Newton, Laplace, and Lagrange on physics and mathematics. By the age of twenty-four he was submitting original papers to the Cambridge Mathematical Journal and at age twenty-nine he won a medal from the Royal Society for his contributions to mathematical analysis. He continued to so impress his contemporaries that five years later he was appointed professor of mathematics at Queens College, Cork in Ireland, even though he had no university degree. At his untimely death of forty-nine, Boole could never have guessed that his new symbolic logic would become essential in the next century for telephone switching and the design of computers. For this practical reason, as well as the sheer intellectual importance of his accomplishment, The Laws of Thought merits our attention today. (shrink)

This article investigates particular issues that remain unexplored or unsettled in the state-controlled banking services sector in Byzantium , comprising the guilds of dealers in bullion and the bankers . It establishes that money-changing remained the exclusive prerogative of the trapezitai and was safeguarded by guild regulations aiming to secure the soundness of the monetary system, while money-lending was governed by statute law and was carried on by trapezitai in competition with other guild members making loans as a sideline activity (...) and private money-lenders operating outside the guild system. The argyropratai dealt in precious metals and stones, undertook appraisals of valuables for a fee, and made, sold or repaired jewelry. The guilds' occupational exclusivity in money-changing and trading and precious metals did not establish a market monopoly, as the guild system did not aim to advance the members' economic interests, thwart intra-guild competition, or achieve equality of financial results for the membership. Neither the state nor the guilds set commissions on currency transactions, prices of precious metals, or fees for services, such determination being left to market forces. (shrink)

The purpose of this paper is to describe the nature of dental practice and to identify some recent innovations which have effect on cost containment in dentistry. The first of these innovations is dental insurance or prepaid dental services. Dental insurance has only recently emerged as a significant economic factor. The chronic and prevalent nature of dental disease mandates that the management of these programs incorporate insurance devices which limit demand and utilization. These devices amount to cost containment measures. The (...) second factor to be discussed is advertising. Advertising has been foisted on the dental profession by recent rulings of the Federal Trade Commission in an effort to promote competition. The Reagan administration, despite a market oriented approach to health care, had attempted to blunt some of the FTC actions. Advertising, nevertheless, has the potential to stimulate competition and restrain price escalation. The third factor includes a discussion of alternative delivery systems. These commercially oriented dental enterprises have the potential to compete with established practices as well as increase the demand for services. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:366 HISTORY OF PHILOSOPHY In harmony with Glaucon or Kant, but unlike Thrasymachus, Ballard is unconvinced by Socrates' virtual identification of virtue with art (T~xpv)or expert knowledge (cf. 24f., 50-79). For the "tragic" intellectualism embraced by both Socrates and Thrasymachus precludes the "existential loyalty" prized by Ballard's Plato and Plato's Glaucon. Against "existential loyalty," Socrates' philosopher-kings, if left to themselves, would commit crimes of omission perhaps more heinous than (...) the crimes of commission perpetrated by Thrasymachus' paragon of wisdom, the perfect tyrant. Although aware that only their leadership can prevent the greatest evils in states, philosophers nevertheless refuse to rule, even in the ideal state, unless compelled (cf. Republic, 519B7-520A4). Thus neither Thrasymachus' tyrant nor Socrates' philosopher would willingly sacrifice their own pleasure and happiness for the common good. Their "epicurean" taste contrasts sharply with Ballard's more Kantian or Biblical call for "existential loyalty." No compulsion would be necessary to obtain the return of Ballard's philosophers to the political responsibilities of the "cave." For his subordination of reason to myth precludes escape from the "cave" either in the satanic direction of Thrasymachus or the divine direction of Socrates (cf. 120). In this sympathetic account of Plato's arguments for the immortality of the soul (as presented in the Phaedo and the Phaedrus) Professor Patterson has attempted to argue that Plato believed that his arguments were complete 'demonstrations' of the immortality of the soul. The author is concerned to indicate the intention, the background, and the structure of the various arguments which Socrates presents in defense of the view that the soul is immortal. In the course of his discussions Patterson seems to involve himself in a number of large issues (e.g, the problem of psycho-physical dualism, the concept of substance, the critique of materialism and epiphenomenalism, and the meaning of Plato's doctrine of Forms) which are not dealt with comprehensively and which transcend the primary concern of his book. The digressions which lead Patterson into exceedingly difficult philosophical problems and, in some cases, into the realm of exotic analogies (e.g., he at one point compares Plato's dualism to the views of Jainism, Hinayana, Samkhya, Nyaya-Vaiseshik, and Mimamsa metaphysics I) detract from the value of the book and tend to divert him from his basic intention. His defences of Plato's arguments are, on the other hand, interesting, if debatable. The basic teaching of the Phaedo is, it is said, that the soul in essence does not belong to the realm of becoming, but is a sempiternal entity. In trying to say what modernism is , we must remind ourselves that it cannot and must not—to be properly described and understood—be confined only to the arts of music, literature, painting, sculpture, theater, architecture, those arts with which we normally associate the term “culture.” Modernism can be said to embrace, in the broadest terms, not only the arts of Western culture but also science, technology, the family, marriage, sexuality, economics, the politics of democracy, the politics of authoritarianism, the politics (...) of totalitarianism, and such academic disciplines as philosophy and the social sciences of sociology and anthropology . Its influence and effects have been all-pervasive. No corner of twentieth-century life has escaped its profound alteration of both the individual and society. It has radicalized all levels of human existence.What, then, is modernism?Some have described it as a state of “chronic revolution,” that is, revolution against the past, against tradition, against history itself. Others have pointed to its voracious appetite for innovation, for the search for the “new,” for the hunger to be “original”—to be the first and last with something unique and difference, whatever that something might be or in whatever area of human endeavor it might arise.Still others have characterized modernism as the application to all realms of human life of forms of structural rationalization, that is, finding rationally structured ways of being and doing regardless of consequences and, more especially, rationalizing away the mysteries and questions which have to do with meaning, that is, morality and ethics—those areas that lie outside the purely rational. And still others have viewed modernism as a condition of freedom within which the individual can be himself, unfettered and uninhibited, released from the drag of superego and conscience, a separate entity of being, unanswerable to others whether in the form of individuals or society as a whole.Last but not least, there are those who continue to see modernism as a self-perpetuating form of avant-gardism, always at the point of the interface between the present and the future, always ready to move on to the next stage because living itself is a process of constant change, constant motion, perpetual transformation. Confusion abounds in Jonathan Kramer’s attempt, in “Can Modernism Survive George Rochberg?” , to reply to the issues I raised in my essay “Can the Arts Survive Modernism? ” . Besides the endemic disarray of his thought process, he confutes and contradicts himself at every turn—either out of his own mouth or out of the mouths of those he quotes to support his position. He is incapable of following his own line of argument either because he doesn’t remember in (...) one part of his paper what he’s said in another or because he doesn’t grasp the logical implications of his own statements sufficiently follow through. Thus he constantly cuts the ground out from under his own feet.Some specific illustrations are in order. First, let me deal with how he “thinks.” To write prose we perforce must use words; and when we use words, it behooves us to know what they mean. All too often Kramer appears not to know what key words he uses do mean—but he marches blindly on through his own jungle of tangled thoughts. For instance, when he says, “A far better example of reductionism in musical scholarship than Schenker’s multilayered theory is Rochberg’s own article,” he reveals a total lack of understanding his key word, “reductionism” . “Reductionism” is the distilled or diminished content left after removing, stripping away, all alternative ways of understanding a situation or problem. That, of course, is what Schenker did in promulgating his theory of tonal practice, and it is clear Kramer understands that much. “Reductionism,” however, hardly describes the presentation of an overview of the impact of modernism on the life of the twentieth century which is what my article does. BackgroundThe emergence of artificial intelligence (AI) in medicine has prompted the development of numerous ethical guidelines, while the involvement of patients in the creation of these documents lags behind. As part of the European PROFID project we explore patient perspectives on the ethical implications of AI in care for patients at increased risk of sudden cardiac death (SCD).AimExplore perspectives of patients on the ethical use of AI, particularly in clinical decision-making regarding the implantation of an implantable cardioverter-defibrillator (ICD).MethodsSemi-structured, future scenario-based (...) interviews were conducted among patients who had either an ICD and/or a heart condition with increased risk of SCD in Germany (n = 9) and the Netherlands (n = 15). We used the principles of the European Commission’s Ethics Guidelines for Trustworthy AI to structure the interviews.ResultsSix themes arose from the interviews: the ability of AI to rectify human doctors’ limitations; the objectivity of data; whether AI can serve as second opinion; AI explainability and patient trust; the importance of the ‘human touch’; and the personalization of care. Overall, our results reveal a strong desire among patients for more personalized and patient-centered care in the context of ICD implantation. Participants in our study express significant concerns about the further loss of the ‘human touch’ in healthcare when AI is introduced in clinical settings. They believe that this aspect of care is currently inadequately recognized in clinical practice. Participants attribute to doctors the responsibility of evaluating AI recommendations for clinical relevance and aligning them with patients’ individual contexts and values, in consultation with the patient.ConclusionThe ‘human touch’ patients exclusively ascribe to human medical practitioners extends beyond sympathy and kindness, and has clinical relevance in medical decision-making. Because this cannot be replaced by AI, we suggest that normative research into the ‘right to a human doctor’ is needed. Furthermore, policies on patient-centered AI integration in clinical practice should encompass the ethics of everyday practice rather than only principle-based ethics. We suggest that an empirical ethics approach grounded in ethnographic research is exceptionally well-suited to pave the way forward. (shrink)

One of the pressing purposes of the foundation of the Institut historique d'études thomistes was to provide a properly historical approach (...) to Aquinas's doctrine which would defend its integrity and authority, and refute the alarming assertations of those outside the Dominican order who were, on the view of its founders, abusing the historical method to undermine the true sense of Aquinas's thought.1 The founders singled out Étienne Gilson (1884–1978), whose Le Thomisme, introduction au système de saint Thomas [End Page 1053] was published a couple of years earlier (in 1919); according to Mandonnet, Gilson's volume distorted the very nature and pedagogy of Thomist philosophy.2 Mandonnet and Gilson would become principal antagonists in the famous debates about Aquinas's thought in the 1920s and 1930s. Less known, however, are their parallel skirmishes in the field of Dante studies. In this article, I suggest that we need to consider the battles in Thomism and Dante studies together, as part of a wider intellectual war that would question the very nature of Catholic theology and philosophy. I first survey the main battlefield—the debates about Aquinas's thought—with specific reference to the controversies in the 1920s and 1930s about Gilson's "Christian philosophy" and about Marie-Dominique Chenu (1895—1990)'s Une école de théologie. In the second part, I turn to the skirmishes in the field of Dante studies between scholars such as, on the one hand, the French Dominicans Mandonnet and Joachim Berthier (1848—1924), who presented Dante as an essentially Thomist and Catholic poet, and, on the other hand, the lay historians Gilson and Bruno Nardi (1884—1968), who deconstructed the "myth of the Thomist Dante" and saw a fundamental disharmony between Aquinas's and Dante's thought, a view which profoundly influenced post-war Dante scholarship to the present day. In light of this intellectual history, in the third part, I reappraise constructively eight alleged points of divergence between Aquinas's and Dante's thought. For the "tragic" intellectualism embraced by both Socrates and Thrasymachus precludes the "existential loyalty" prized by Ballard's Plato and Plato's Glaucon. Against "existential loyalty," Socrates' philosopher-kings, if left to themselves, would commit crimes of omission perhaps more heinous than (...) the crimes of commission perpetrated by Thrasymachus' paragon of wisdom, the perfect tyrant. Although aware that only their leadership can prevent the greatest evils in states, philosophers nevertheless refuse to rule, even in the ideal state, unless compelled (cf. Republic, 519B7-520A4). Thus neither Thrasymachus' tyrant nor Socrates' philosopher would willingly sacrifice their own pleasure and happiness for the common good. Their "epicurean" taste contrasts sharply with Ballard's more Kantian or Biblical call for "existential loyalty." The author is concerned to indicate the intention, the background, and the structure of the various arguments which Socrates presents in defense of the view that the soul is immortal. In the course of his discussions Patterson seems to involve himself in a number of large issues (e.g, the problem of psycho-physical dualism, the concept of substance, the critique of materialism and epiphenomenalism, and the meaning of Plato's doctrine of Forms) which are not dealt with comprehensively and which transcend the primary concern of his book. The digressions which lead Patterson into exceedingly difficult philosophical problems and, in some cases, into the realm of exotic analogies (e.g., he at one point compares Plato's dualism to the views of Jainism, Hinayana, Samkhya, Nyaya-Vaiseshik, and Mimamsa metaphysics I) detract from the value of the book and tend to divert him from his basic intention. Martin Luther who did the famous early translation of the Bible into German wrote in a letter, “If anyone does not like my translation, they can ignore it… (September 15, 1530)”. There are no ‘correct’ translations. Some are just better than other translations. -/- The Oldest Systematic Program of German Idealism. The German title is: Das Älteste Systemprogramm Des Deutschen Idealismus. This title was made up by Franz Rosenzweig in 1917, when he first published the manuscript. He found the manuscript in the Royal Library in Berlin in 1913. The manuscript suggested date is around 1796 and was done by handwriting research. However, the manuscript is not dated. The Prussian State Library auctioned in March 1913 from the auction of the house Liepmannssohn in Berlin a single sheet on the front and back with Hegel's cursive handwriting. The manuscript was lost during WWII. But Dieter Henrich found it again in 1979 in the “Biblioteka Jagiellonska” in Krakow (Poland), where it is today. Later research suggests that manuscript had come from the estate of Hegel’s student Friedrich Christoph Förster (1791-1868). Anyone familiar with contemporary French culture could not fail to notice that, in the field of ideas, history and the philosophy of history occupy in France a more central place than in England or North America. The work and concerns—including the methodological concerns—of historians like Marc Bloch, Fernand Braudel and the Annalistes, Georges Lefebvre, Emmanuel Le Roy Ladurie, Michel de Certeau, Jacques Le Goff and Francois Furet, are known, discussed and taken on board by most French intellectuals and academics.

The significance of political-economic context for scientific citizenship is argued through an analysis of New Zealand’s Royal Commission on Genetic Modification. My intention is not to provide an account of why the commission came to the decisions it did but to illustrate how the political-economic context and the culture of regulatory science both exacerbate public concerns about unacknowledged uncertainty and commercial influence and make it difficult for those concerns to influence the outcomes of public dialogues. The discursive (...) flexibility of science as alternately predictive and provisional silences concerns about uncertainty, while a further interpretive choice of science as the autonomous activities of individuals unconstrained by political-economic context occludes the nature of concerns about commercial influence. Rather than the increasingly prevalent focus on processes of engagement, I argue that it is essential that researchers in this area attend to how public dialogue is placed in relation to the cultures and structures of regulatory science and neoliberalism. The debate about genetic modification (GM) can be seen as characteristic of our time. Environmental groups, in challenging GM, are also challenging modernist faith in progress, and science and technology. In this paper we use the case of New Zealand's Royal Commission on Genetic Modification to explore the application of science discourses as used by environmental groups. We do this by situating the debate in the framework of modernity, discussing the use of science by environmental groups, and deconstructing (...) the science discourses evident within environmental groups' submissions to the Commission. We find science being called into question by the very movement that has relied on it to fight environmental issues for many years. The environmental groups are challenging the traditional boundaries of science, for although they use science they also present it as a culturally embedded activity with no greater epistemological authority than other knowledge systems. Their discourses, like that of the other main actors in the GM debate, are thus part of the constant re-negotiation of the cultural construct of 'science'. (shrink)

As part of the Securities and Exchange Commission’s revision of Regulation S–K, which lays out reporting requirements for publicly-listed companies, many investors proposed the mandatory disclosure of sustainability information in the form of environmental, social and governance data. However, progress is contingent on collecting evidence regarding which sustainability disclosures are financially material. To inform this issue, we examine materiality standards developed by the Sustainability Accounting Standards Board. Firms voluntarily disclosing more SASB-identified sustainability information exhibit greater price informativeness, while the (...) disclosure of non-SASB information does not relate to informativeness. The results are robust to a changes analysis and a difference-in-differences analysis that exploits the staggered release of SASB standards across different industries over time. We also document stronger results for firms with higher exposure to sustainability issues, poorer sustainability ratings, greater institutional and socially responsible investment fund ownership, and coverage from analysts with lower portfolio complexity. Bryce, Ian The following are my personal observations based on several visits to public hearings of the Royal Commission into Institutional Responses to Child Sexual Abuse. I've also included media reports, and what I've learnt from contacts with interest groups. I recommend others sit in a public hearing for a day, to see the system in action.

“Punishment,” writes J. E. McTaggart, “ is pain and to inflict pain on any person obviously [requires] justification.” But if the need to justify punishment is obvious, the manner of doing so is not. Philosophers have developed an array of diverse, often conflicting arguments to justify punitive institutions. Gertrude Ezorsky introduces this source book of significant historical and contemporary philosophical writings on problems of punishment with her own article, “The Ethics of Punishment.” She brings together systematically the important papers and (...) relevant studies from psychology, law, and literature, and organizes them under five subtopics: concepts of punishment, the justification of punishment, strict liability, the death penalty, and alternatives to punishment. This paper argues that while regulatory frameworks in aged care authorise restraints to protect vulnerable persons living with dementia from harm, they also serve as normalising practices to control challenging monstrous Others. This argument emerges out of an observed unease in aged care discourse where older people living with dementia are described as ‘vulnerable’, while dementia behaviours are described as ‘challenging’. Using narrative analysis on a case study from the Final Report of the Australian Royal Commission into Aged (...) Care Quality and Safety (RCAC), this paper investigates how the RCAC (re)produced constructions of persons with dementia as ‘vulnerable monsters’. Drawing upon monstrous theory about ‘unruly and leaky’ bodies, extracts from the case study reveal how the RCAC repeated and reinforced monstrous constructions of dementia. Dementia behaviours, particularly ‘wandering’, were constructed through a dehumanising crisis frame that produced ‘challenging’ bodies and legitimised ‘last resort’ normalising practices, such as physical and chemical restraints. In failing to resist monstrous constructions of dementia behaviours, the RCAC accepted and authorised a regime of scaled responses leading to restrictive practices for control of challenging bodies in aged care. Although dementia care and restrictive practices received substantial attention in the RCAC, this paper reveals a missed opportunity for deeper review of institutionalised use of restraints that has relevance for ongoing reform of Australian aged care following conclusion of the RCAC. Previous studies investigating reports of corporate or individual wrongdoing have failed to examine the effects of an organization's structure upon the decision to blow the whistle. This paper suggests that an organization's structure may perform a significant role in the decision to report versus not report an observed wrongdoing. Five organizational structures were examined in regards to their effectiveness in encouraging or discouraging observers of unethical conduct channels for reporting such behavior. Discussion and implications are provided.

George Berkeley (1685-1753) is the superstar of Irish Philosophy. He entered Trinity College, Dublin, in 1700 and became a fellow in 1707. In 1724 he resigned his Fellowship to become Dean of Derry, and in 1734 he was made Bishop of Cloyne. He settled in Oxford in 1752 and died the following year. The work of George Berkeley is marked by its diversity and range. His writings take in such topics as mathematics, psychology, politics, health, economics, deism and (...) education, as well as that with which he is most associated - philosophy. Whatever topic he dealt with, his grasp of the subject matter was always impressive and his criticisms of his contemporaries often acute. Among the most noteable of the British Empiricists, he took his starting point from Locke's new 'way of ideas', but he rejected abstract ideas and the possibility of real existence outside perception. It is for this doctrine that he is most known - that there is no such thing as matter, and that things are collections of ideas which can exist only in our minds and only for so long as they are perceived. This philosophy, summed up in his phrase 'to be is to be perceived', he termed 'immaterialism'. A.C. Fraser's collection includes a series of what were previously unpublished notes by Berkeley on all the main topics of his philosophy. In this wide-ranging collection of essays on origins, mathematician Granville Sewell looks at the big bang, the fine-tuning of the laws of physics, and the evolution of life. He concludes that while there is much in the history of life that seems to suggest natural causes, there is nothing to support Charles Darwin’s idea that natural selection of random mutations can explain major evolutionary advances. Sewell explains why evolution is a fundamentally different and much more difficult problem than others (...) solved by science, and why increasing numbers of scientists are now recognizing what has long been obvious to the layman, that there is no explanation possible without design. This book summarizes many of the traditional arguments for intelligent design, but presents some powerful new arguments as well. (shrink)
